One Arrested in Overnight Accident, Alcohol Cited as Contributing Cause

Via inforney.com: FORNEY, Texas — A man was arrested overnight after allegedly causing a two-vehicle crash which injured two individuals and fleeing the scene — prompting a brief manhunt involving a Texas Department of Public Safety helicopter.
The crash was reported just after 2:30 a.m. on Wednesday, March 23, 2016, on westbound U.S. Highway 80 near Pinson Road.

Forney Police Department Detective Michael Clay says the driver, identified as 30-year-old Duston Nipp of Mesquite, Texas, fled the scene of the crash on foot into a nearby wooded area— in between U.S. Highway 80, Pinson Road, Brazos Road, and Lovers Lane — and climbed approximately 10 to 15 feet up a tree.

A responding DPS helicopter was able to spot Nipp in the tree and instructed officers on the ground to his location.

Nipp was then instructed, at gun point, to come down from the tree. Nipp complied and was arrested without further incident.

Two people from the vehicle Nipp struck were transported to Parkland Memorial Hospital in Dallas, Texas.

Nipp now faces a charge for accident involving serious bodily injury and two charges for intoxication assault with a vehicle.

Commentary:
Drunk driving accidents is one of the single greatest causes of property damage on Texas highways. When a person is driving under the influence of alcohol their ability to drive is inherently impaired. The decisions they make, their response time, and their ability to maintain proper control of the vehicle are naturally impaired by the introduction of alcohol in their system.
Although it is commonly known that people who cause drunk driving accidents are arrested for DWI, and often times reckless driving, etc.., however, there are civil actions for negligence and negligence per se, among potentially others, against drunk drivers that will allow you to recover costs of medical bills and property damage that are caused by the drunk driver. Wrongful death and survivor actions are available. What makes your case stronger is the fact that these people were cited for criminal activity which lends credibility to your civil case that the person did something wrong and caused your injuries.
