Commentary: It is clear from the report that for some reason southbound vehicle swerved into the eastbound lanes and struck Ms. Cameron’s vehicle. Mr. Davis’ actions were likely negligent. Driver’s of vehicles have a duty to maintain the vehicles that they are driving in a manner that that does pose a danger to others. Namely, maintaining their lanes of traffic, traveling at a safe speed under the circumstances, among others. The vehicle driven by Mr. Davis came over the line and struck Ms. Cameron. So, obviously there was a breach of duty. Mr. Davis may have had a medical emergency that caused him to do this, but we have very little information and in most cases where this type of accident occurs, its not a medical emergency that caused the accident, its distractions, fatigue, alcohol or animals in the road.
Therefore, Ms. Cameron’s estate will likely have claims against Mr. Davis’ estate and his insurance company. Our thoughts and prayers are with both families in this difficult time. Losing a loved one is one of the most difficult realities of life.
