Personal-Injury-Law-300x149When a personal injury or wrongful death occurs, there is a statute that limits the time period for which a person or an estate can bring a lawsuit against the at-fault party. This is known as a “Statute of Limitations”.

The Texas Civil Practice and Remedies Code, Chapter 16.03 provides our answer to the statute of limitations for all personal injury and wrongful death actions in Texas:

Sec. 16.003. TWO-YEAR LIMITATIONS PERIOD. (a) Except as provided by Sections 16.010, 16.0031, and 16.0045, a person must bring suit for trespass for injury to the estate or to the property of another, conversion of personal property, taking or detaining the personal property of another, personal injury, forcible entry and detainer, and forcible detainer not later than two years after the day the cause of action accrues.

GuestandGrayLogoGuest and Gray, P.C. is the advocate of choice for landowners from Kaufman county, Rockwall county and Hunt county. We service all areas of Northeast Texas, from Forney to Farmersville, Greenville to Terrell, and all outlying areas of East and Northeast Texas.  We have a 100% success rate in obtaining additional compensation for our clients who face condemnation by a condemning authority. Our goal is to fight for the rights of landowners against the unfair process of eminent domain.

In all condemnation proceedings, there are two things that the government, or their authorized entity, such as a water district or electricity provider, must demonstrate: that the taking is for a “public use”, and they must pay the landowner “just compensation”.

These are hard and fast rules, but what exactly constitutes a “public use” and “just compensation” can be a bit of a mystery.

RockwallHarbor2Rockwall is known for a lot of things. Everyone knows that Rockwall is usually acclaimed to be the Wealthiest County in Texas. Although there are short periods, often during oil booms, that Rockwall is unseated from that throne, Rockwall is always near the top. Why? Because it is close to Dallas and other major business hubs, and it is located in a beautiful area overlooking Lake Ray Hubbard. People like that.

Rockwall is also known for Lake Ray Hubbard. A great lake for catching bass and perch. Occasionally, you will hear of reports of an Alligator swimming around. We live in North East Texas. It happens. The lake has drawn a lot of people and retail shopping to the Rockwall area. Theoretically, it is easy to get to Rockwall with access from I-30, the tollway, Highway 67, Highway 205, you name it. The problem is the third main thing that Rockwall is known for: Traffic.

ROCKWALL TRAFFIC IS NOTORIOUS

We believe this makes us uniquely capable of serving this area because, well, we know the area. We know what areas are particularly dangerous for drivers and where the majority of accidents occur. We know why. We know that Kaufman county and Rockwall county are experiencing unprecedented growth and that the increased traffic in areas like Rockwall, Forney and Terrell are leading to more accidents. We know that Terrell’s commercial growth will lead to more truck accidents and Forney’s residential growth will lead to more injury accidents involving passenger vehicles.

CatastrophicInjuryPicIn the field of catastrophic injury law, we are often confronted with the question, “What makes an injury catastrophic?” This seems like a reasonable thing to ask, especially since the term “catastrophic injury” can occur in a variety of contexts, from truck and auto accidents, to work place injuries, to prime time television.

The reality is that I can only provide you with a working definition that is widely used by fellow lawyers and also in the medical community. There is no statute or case law that really buttons down what a catastrophic injury is simply because it can take so many shapes.

Catastrophic Injury Typically Means a Permanent Impairment

Stock-Accident-PhotoThe holiday package delivery time is in full swing for carriers like UPS and Fed EX. UPS expects this to be one of the busiest years ever for them, with an expected 750 million packages shipped over the Christmas holiday. That is a lot of boxes, people! All over the news we are hearing of the horrors of driving for these companies, with stories like this one where an Amazon delivery man actually pooped in someone’s driveway and drove off. Many other stories have come out about the carriers practices causing drivers to work long hours with no breaks and practically having to speed every where they go to make deliveries on time. As a result, we have seen a huge increase in the number of accidents involving drivers of UPS, Fed Ex, Amazon and the like over the last few years.

According to the Federal Motor Carrier Safety Administration website, in the 24-month period prior to December 3, 2017, UPS drivers were reported to have been involved in 2,003 crashes, 689 involving injuries, including 49 deaths. Since 2012, the number of crashes has increased by 38%; the number of injures has increased by 27%; and the number of fatalities has increased by 25.6%. Those may seem like crazy high statistics, but wait until we get to FedEx. Their numbers are astronomical.

Also according the Federal Motor Carrier Safety Admnistration, in the 24-month period prior to December 3, 2017, FedEx Express drivers were reported to have been involved in 1762 crashes, 575 involving injuries, including 41 deaths. Since 2012, the number of crashes has increased by 254.5%; the number of injuries has increased by 192%; and the number of fatalities has increased by 273%. 273%! That is awful.
