social-image-logo-og-300x300Guest and Gray is one of the fastest growing firms in North East Texas, and for good reason. The Dallas-Fort Worth Metroplex boom has been ongoing for the better part of 30 years, and the boom is now making its way south and east of the metroplex, with areas such as Forney, Terrell, Canton, Greenville, Tyler, and many other parts of east Texas seeing the effect of people either running away from the growth (and incidentally causing growth) or moving into the areas from other parts of the country. In Forney, a large percentage of the people moving in are from out of state, such as California, who are running away from the high taxes in those places.

At Guest and Gray, we saw this coming years ago. Most of our attorneys and staff grew up in the east Texas area and we saw the neighborhoods going up and the roadways being built. We knew a long time ago that our areas would be next. So, we decided to commit to serving these areas and those who live here.

As personal injury lawyers, we knew that the increased growth would have a negative impact on our roadways in that it would increase traffic, and as a result, increase the frequency and severity of accidents. So, we developed a practice acutely designed to handle a wide range of personal injury cases, from standard negligence cases such as car accidents, to more complex ones like 18-wheeler accidents, wrongful death claims, and dog bite cases. Our firm has helped hundreds of East Texans recover top compensation for their injuries.

Kaufman County is in the midst of a historic residential construction boom. Anyone driving through Forney, Terrell, Kaufman or Crandall will attest to this fact. Neighborhoods are popping up, seemingly, overnight. With that, developers, builders and individual home buyers and sellers are seeing an equal rise in the number of real estate disputes.

In our office, the main issues seem to be with individual home builders performing substandard work or failing to complete the construction of new homes. This can create quite the mess for home buyers who took out construction loans and are now paying their current mortgage, on top of the interest on their construction loan. On top of that, due to shoddy construction practices, they are having to pay additional amounts out of pocket, or reworking loans, in order to have their homes completed. With that, Texas provides certain protections under the RCLA (Residential Construction Liability Act) which protects homeowners in the event that a home builder performs defective or substandard work on a new home. Homeowners are also having issues with eminent domain. Eminent domain/condemnation proceedings have been instituted against several landowners in the last few years for rights of way and easements for utility companies and roadways through TxDot. If you face condemnation for all or part of your property, you need to consult with the attorneys at Guest and Gray. We have successfully negotiated and tried condemnation cases for families and businesses across Kaufman County and East Texas.

For developers, we are seeing issues related to re-zoning and zoning variances, land-purchase disputes, disclosure issues and right of way and easement issues. Many of these issues may be addressed in Court through specific performance, declaratory judgment or a breach of contract case.

Guest and Gray, P.C. has successfully helped countless personal injury and wrongful death victims and their families recover under their uninsured/underinsured motorist policies in the greater Dallas-Fort Worth areas, including Forney, Dallas, and Rockwall counties.

Making and Uninsured/Underinsured Claim in Texas

Making an uninsured motorist claim is much like making claims against the at-fault party’s insurance, except that this is typically your own “excess” policy to help take care of medical bills and lost wages when you have already maxed out the at-fault party’s liability policy.

Guest and Gray, P.C. is committed to helping dog attack victims recover top dollar for their injuries. Dogs are often thought of as “man’s best friend”, but that is not always the case. This is especially true in Texas where we lead the nation in Dog Bite Fatalities. Dog’s can attack without warning and for no apparent reason. Guest and Gray, P.C. has represented numerous dog bite victims in the Dallas, Forney, and Rockwall county areas and recovered top dollar for their injuries.

Establishing “Negligence” in a Dog Bite Case

In order to recover damages after a dog attack, the injured victim must show that the owner, aware of the dog’s aggressive tendencies, failed to use reasonable care to prevent the dog from harming someone. For instance, if the owner of a known aggressive dog regularly lets the dog out in the street or neighborhood, and that dog attacks someone, the homeowner will likely be liable under a negligence theory of recovery in Texas.

Terrell is Kaufman County’s Budding Business and Recreational Hub

If Forney is the residential complex of Kaufman County, Terrell is its business and recreational hub, and Terrell’s housing market is on the rise. What does this mean for Terrell? People on the roadways. As more businesses and people move into town, Terrell is going to see an uptick in personal injury and wrongful death cases. The numbers simply go hat-in-hand with one another. The bigger the city, the more accidents and deaths related to motor vehicle travel.

GuestandGrayLogoGuest and Gray, P.C. is the advocate of choice for landowners from Kaufman county, Rockwall county and Hunt county. We service all areas of Northeast Texas, from Forney to Farmersville, Greenville to Terrell, and all outlying areas of East and Northeast Texas.  We have a 100% success rate in obtaining additional compensation for our clients who face condemnation by a condemning authority. Our goal is to fight for the rights of landowners against the unfair process of eminent domain.

In all condemnation proceedings, there are two things that the government, or their authorized entity, such as a water district or electricity provider, must demonstrate: that the taking is for a “public use”, and they must pay the landowner “just compensation”.

These are hard and fast rules, but what exactly constitutes a “public use” and “just compensation” can be a bit of a mystery.
